1. BOOKING AND GENERAL GUIDELINES

a.   The booking of the property is legally binding upon receipt of the booking confirmation or after (deposit) payment has been made. Bookings can be made through the website www.chant-des-sapins.com, online portals such as AirBnB, etc., as well as email or other means of communication. The guest is obliged to check the booking confirmation for accuracy and to immediately draw attention to any discrepancies with the booking request.

b.   Compliance with the GTC is a basic requirement for the use of the property. Non-compliance may result in consequences such as a deduction from the rental deposit or additional claims. Guests must follow the GTC as well as instructions of the owner / concierge.

c.   Subletting or reletting the property or using it for other than residential purposes is not allowed.

d.   These terms and conditions are partially detailed in the “Guest Information”, which is displayed in the house as well as accessible online, and must also be followed.

e.   German law is applicable.

2. PAYMENT AND CANCELLATION CONDITIONS

a.   Unless otherwise agreed in the context of the booking, e.g. via an online platform, the payment of the total amount is due at the time of booking. Additional costs for water, electricity and waste are included in the accommodation price. A cleaning fee will be charged separately.

b.   If no other arrangement is made within the framework of the booking, e.g. via an online platform, 90% of the travel price will be refunded in the event of cancellation on the part of the guest up to 2 months before arrival, 50% up to 1 month before arrival, and 0% thereafter.

c.   In case of cancellation by the owner due to force majeure or other unforeseeable circumstances, the liability is limited to the refund of the total cost. In the case of justified withdrawal, no claim for damages arises, liability for travel and hotel costs will not be accepted.

3. GUESTS, EVENTS AND NOISE LEVEL

a.   The property is suitable for adults as well as children of all ages. Guests are responsible for the safety and behavior of children present at all times.

b.   The property is designed for a tour group of no more than 10 people. This also includes potential day guests. Additional visitors may be received only with the prior explicit consent of the owner.

c.   We ask that residents be treated with respect. Guests should not make a lot of noise especially at night between 22:00 and 07:00. Parties and other large gatherings are not allowed. For private gatherings, guests must adhere to the guidelines for volume and total number of people. Excessive noise is prohibited at any time of the day or night and may result in the property being vacated.

4. SMOKING AND PETS

a.   The property is suitable for people with allergies. Therefore, smoking is strictly prohibited inside the property. Outside, cigarette butts must be properly disposed of (e.g., in the ashtray) and must not be thrown on the property.

b.   Pets are not allowed on the property.

5. LIABILITY OF THE OWNER

a.   The owner is liable within the scope of due diligence for the correctness of the description of the property as well as for the proper provision of the rental property and is obliged to provide agreed services properly. Photos and texts on website, flyers or online booking portals serve as a realistic description, a 100% match cannot be guaranteed. The owner reserves the right to make changes to the equipment (e.g. furniture), provided that they are of equal value.

b.   The owner is not liable for any influence on the rental object due to force majeure, power and water failures common in the country and thunderstorms. Likewise, no liability is accepted for the occurrence of unforeseeable or unavoidable circumstances such as official orders, construction sites or for disruptions caused by natural and local conditions.

c.   Liability of the owner for the use of the tennis court and pool as well as provided play and sports equipment is excluded. The owner is not liable for personal belongings in case of theft or fire.

6. OBLIGATIONS OF THE GUESTS

a.   Guests agree to treat the property, including inventory and outdoor facilities, with care. Guests are liable for damages to furnishings, buildings as well as associated facilities if and insofar as they have been caused culpably or negligently. To avoid damage, no furniture may be moved from one room to another (without prior agreement).

b.   Defects and damages already detected upon arrival must be reported immediately to the owner / concierge. A reasonable period of time must be allowed for the repair of damages and defects. Complaints received only at the end of the stay or after leaving the property are excluded from compensation.

c.   Guests are obliged to inform the owner / concierge immediately of any defects or possible malfunctions of the property, inventory, facilities or technical equipment. Claims arising from complaints that are not reported immediately on site are excluded. Guests are obligated to do everything reasonable within the scope of their legal obligation to contribute to the elimination of the disturbance and to keep any resulting damage to a minimum.

d.   The property has its own sewage system and is not connected to the public sewage system. Waste, ashes, harmful liquids and the like must not be put into sinks / washbasins and toilets. If damage to the sewage system occurs due to failure to comply with these provisions, the party responsible shall bear the cost of repair.

e.   Whenever leaving the property, it is the responsibility of the guests to ensure that all windows, doors and gates are closed to ensure safety and prevent damage, e.g. due to rain penetration. Air conditioners must be turned off when not in use to conserve energy.

7. ARRIVAL, DEPARTURE AND ACCESS

a.   As a guest, you will receive a gate and front door access code. The code is only valid within the rental period and must not be given to third parties outside the tour group, just like the keys and fob in the house.

b.   The arrival time can be flexible from 15:00. The owner should be informed about the planned arrival time so that the concierge can explain all the peculiarities of the property to the guests within the first hour after arrival. In case of late arrival, no later than the next morning.

c.   Upon departure, we ask our guests to vacate the accommodation no later than 10:00 am. The owner or concierge should be informed in advance of the planned departure time so that a handover can take place within the last hour before departure. Windows, front door and gate are to be locked upon departure. Keys and fob will remain in the villa before leaving.

d.   Guests should park their vehicles on the property. There are three full parking spaces available, and two additional vehicles may be parked in the turning circle. The electric charging station may be used free of charge. The equipment and cables must be handled with care.

8. COMMODITIES, CONSUMABLES AND TOYS

a.   Shampoo, shower gel, body lotion, toothbrushes, toothpaste, disposable razors, etc. are available in the bathrooms. Coffee capsules, tea, spices, etc. are found in the kitchen and are welcome to be shared. They are provided for moderate use on site.

b.   Any items accessible in the property such as sports racquets and toys are welcome to be used. These must be treated with care and put back after use.

9. CLEANING AND WASTE SEPARATION

a.   We ask that you keep the property clean at all times and remove any dirt caused directly. Please also put used dishes back in the cupboards in a clean condition and leave the villa in a tidy state. All cleaning products and utensils in the utility room may be used.

b.   Laundry baskets are available in the bathrooms for used towels as well as napkins.

c.   Please separate waste during your stay according to local guidelines. Full waste bags are to be disposed of in the public containers outside the property. Sorting system as well as container location are described in the guest information on site or online.

10. BARBECUE AND FIREPLACE

a.   Guests may use the charcoal grill in accordance with customary use and under constant supervision. The grill must be safely placed on the stone patio, at least 2 feet from the house, and a sufficient distance from combustible material. Burning or glowing charcoal shall not be disposed of on the property or in trash receptacles.

b.   The fireplace may be loaded with suitable amounts of wood and fired with the glass closed. Cooled ashes shall remain in the fireplace.

c.   Supervision of children present is the responsibility of the guests.

11. POOL

a.   The pool may be used at any time. It is equipped with a child safety device that is required by law to be used at all times when the pool is not being used in a supervised manner. You are responsible for the safety of all guests in and around the pool during your stay. Please use extra caution when children are using the pool or even just being on the property.

b.   Do not operate the child safety lock motor unless the cover hooks are released. Damage resulting from disregard must be replaced.

c.   For safety reasons, bottles or glasses are not allowed in or around the pool area. Plastic cups are available for use.

12. TENNIS COURT, GOLF COURSE AND FITNESS CHALET

a.   The tennis court is available for free use. In order to protect the ground, we ask that you take care not to carry pebbles into the facility, for example, through shoes. If the ball machine is used, it must be stored indoors after use and protected from rain at all times.

b.   To use the 3-hole golf course, please tee off only in the designated zones, never from the green. Please take care, as always in golf, not to endanger people or property. Clubs can be found in the Fitness Chalet with the request that they be treated with care.

c.   Exercise equipment in the Fitness Chalet may only be used in accordance with its normal use and at your own risk. Guests are fully responsible for their own safety and especially the safety of any children present. We recommend that you always lock the Fitness Chalet when children are on the premises.

13. WIRELESS INTERNET

a.   For the duration of the stay, guests are allowed shared use of WLAN access to the internet. Access data (login and password) may not be disclosed to third parties under any circumstances. The owner does not guarantee the actual availability, suitability or reliability of the internet access for any purpose. The use is at the guests’ own risk and peril.

b.   Guests undertake not to use the WLAN for retrieving or distributing immoral or illegal content; not to unlawfully reproduce, distribute or make accessible any copyrighted goods; to observe the applicable youth protection regulations; not to send or distribute any harassing, defamatory or threatening content; not to use the access for any illegal activities.

14. DATA PROTECTION

a.   Guests agree that exchanged data about their person can be stored and passed on in the context of the contract processing. All personal data will be treated confidentially.

15. EMERGENCY

a.   In case of emergency, please dial: 15 for ambulance, 17 for police and 18 for fire department or European emergency number 112.

b.   Fire extinguishers are located in the utility room, kitchen and next to the grill.

16. AGREEMENT

a.         Violation of these T&C is a violation of the terms and conditions of the property’s lease. The owner reserves the right to terminate the rental and to evict guests who refuse to comply with these
